Spanish nationality by residence

Application to the Ministry of Justice. The fee published on its pages is €104.05, form 790 code 026, paid beforehand and in the name of the person concerned.

Open the nationality e-office (opens in a new tab)

The button opens the administration’s website in another tab. MiCitas does not sign in or fill anything in there.

Who it is for

It may be filed by someone aged 18 or emancipated; a person over 14 with their legal representative; the minor’s representative; and, depending on the case, a person whose capacity has been modified or their representative. The Civil Code sets different periods of legal residence according to country of origin and other cases.

  1. 1

Check the residence period in Article 22

The Civil Code starts from ten years of legal residence. It reduces that to five for refugees, to two for nationals of Ibero-American countries, Andorra, the Philippines, Equatorial Guinea, Portugal and Sephardic people, and to one in several cases (including birth in Spain or one year of marriage to a Spanish national). Residence must be legal, continuous and immediately prior, on the terms of the article.

  2. 2

    Pay €104.05 with form 790-026

The information page and the ministry notice say €104.05. Payment is beforehand, in Spain, in the applicant’s name and requires a NIE or DNI. Do not photocopy the form: the number must be unique. Confirm the figure on the form the day you pay.

  3. 3

    File through the e-office

The e-office offers online filing and the download of form 790 for in-person payment. Follow that office, not the police immigration appointment.
